Publix vs. Winn-Dixie: Who Won In 2015?

Every day, Publix and Winn-Dixie battle for customers attention and business, but we know who the real winner is for getting sued for slip and falls in Broward County. Publix was sued 44 times while Winn-Dixie was sued 26 times for slip and falls in 2015. Here are some examples of slip and fall lawsuits against Publix (these are not our cases):

R.S.  v.  Publix Super Markets, Inc.
Slip and fall due to soapy liquid on the floor while in the detergent aisle.

K.D.  v.  Publix Super Markets, Inc.
Injury due to stepping on hazardous material on floor with no warning of construction site or hazardous material.

E.A.  v.  Publix Super Markets, Inc.
Fall while ascending from parking lot to the sidewalk curb in front of Publix.

T.V.  v.  Publix Super Markets, Inc.
Fall in womens’ restroom due to stall door falling off its hinges and knocking her onto the ground.

K.N.  v.  Publix Super Markets, Inc.
In parking lot there was a large tree near where she parked her car that dropped a lot of seeds/pods which she stepped and slipped because of.

L.R.  v.  Publix Super Markets, Inc.
Dirty foreign liquid substance accumulated on the floor causing plaintiff to slip and fall.

Slipped and fell in liquid approaching the exit of the store.

Slipped and fell on a piece of plastic while on the premises.

Grocery stores like Publix and Winn Dixie have a legal duty of care; under Florida law, they are supposed to have people routinely checking the floors and aisles to make sure that they are safe and secure, and to mop up any spills and move any obstacles in the aisles. If a customer is hurt, the customer will have to prove that these employees did not do their job and as a result the customer was injured.  Proving  this breach of duty can be accomplished through discovery, including depositions and reviewing videotape footage of the accident scene. Publix is a good company, but with so many stores, so much merchandise, and so many employees, injuries resulting from the negligence of its employees are going to occur with some frequency.
